Agreeing to these terms
These terms cover your use of this website and any work you hire Thermal Gilroy Spray Foam Insulation to do. By using the site, asking for an estimate or booking a job with us, you agree to them. If you don't agree, please don't use the site or book work through it.
In these terms, "we", "us" and "our" mean Thermal Gilroy Spray Foam Insulation. "You" means the person using the site or the property owner or manager who hires us. You can start from our home page to see the services we offer.
What we do
We're an insulation contractor in Gilroy, CA. We install, add to and remove insulation in attics, walls, crawl spaces and basements, apply spray foam, seal air leaks and install vapor barriers for homes and commercial buildings in Gilroy and the cities around it. You can read more about who we are on our About page.
The descriptions on this site are general. They explain the trade and how jobs usually go, and they aren't a promise about your building. The exact work, materials and scope for your job are the ones written in your estimate or contract.
Estimates and pricing
We give free on-site estimates, and there's no pressure to book. An estimate is based on what we can see and measure at the visit, such as the size of the space, what's already up there, how easy it is to reach and the material you choose.
Some conditions only show up once the work starts, like insulation that's wet or full of droppings, damaged framing, or hidden gaps that need sealing. If we find something that changes the scope or the price, we stop and talk with you before doing the extra work. We won't add work to your bill without your approval.
Unless your estimate says otherwise, an estimate is good for 30 days from the date we give it to you. After that, material and labor costs may change and we may need to update the price.
Scheduling and cancellation
We set a start date with you once you approve the estimate. Weather, material supply, access to the property and conditions found on site can move a schedule, and we'll let you know as soon as we know a date needs to change.
You agree to give our crew safe access to the work areas on the scheduled day, which usually means clearing a path to the attic hatch, crawl space or walls we're working on. If we can't get in or the space isn't ready, we may need to reschedule.
Some jobs, spray foam in particular, require that people and pets stay out of the house for a set period while the material cures. Our crew will tell you the re-entry time, which is when it's safe to come back, before the job starts. You agree to follow it and to follow any instructions from the material maker that we pass on to you.
If you need to cancel or move your appointment, please call us at (669) 205-6284 as early as you can. If we've already ordered special materials for your job, or your contract sets out a cancellation charge, those terms apply.
Payment
Payment terms, including any deposit and when the balance is due, are written in your estimate or contract. Unless it says otherwise, payment is due when the work is complete.
If a payment is late, we may pause work on the job until the account is brought current. You're responsible for reasonable costs of collecting an overdue balance, as California law allows.
Our guarantee and what it doesn't cover
We're licensed and insured, and our work is backed by our satisfaction guarantee. If something about our work isn't right, call us and we'll come back and look at it.
Insulation materials carry the maker's own warranty, and those warranties are handled under the maker's terms. Apart from our guarantee and any written warranty in your contract, we make no other promises about the work or the site, whether stated or implied, to the extent the law allows.
We can't promise a specific drop in your power bill or a specific indoor temperature, because those depend on things outside our work, such as your heating and cooling system, windows, how the house is used and the weather.
Our guarantee doesn't cover damage from leaks, pests, other trades working in the same space, changes made after we finish, or problems in parts of the building we didn't work on.
Limits on our liability
To the extent the law allows, our total liability for any claim tied to a job is limited to the amount you paid us for that job. We aren't liable for indirect or consequential losses, such as lost use of the property, lost income or higher utility costs.
This website is provided as is. We try to keep it accurate and working, but we don't promise it will always be available, current or free of errors, and we aren't responsible for losses from relying on general information here instead of an on-site estimate. Links to outside sites are for convenience, and we don't control those sites.
Nothing in these terms limits liability that California law doesn't allow us to limit.
Settling a disagreement
If you're unhappy with any part of our work or these terms, call us or reach us through our Contact page first. Most problems get sorted out quickly once we talk and, where it helps, come back out to look.
If we can't work it out between us, either side can take the matter to a court with jurisdiction in Santa Clara County, California, including small claims court where the amount qualifies.
Which law applies
These terms and any work we do are governed by the laws of the State of California, without regard to rules that would point to another state's law.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one in effect. Changes don't affect a job already under a signed estimate or contract unless we both agree in writing.
If any part of these terms is found unenforceable, the rest still applies.
Questions about these terms
If you have a question about these terms, call us at (669) 205-6284 or send a message through our Contact page. We reply within 1 business day.
